These Terms of Service ("Terms") constitute a legally binding agreement between you and AI Motion Control ("we," "our," or "us") regarding your access to and use of the aimotioncontrol.app website and our AI-powered motion control and video generation services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
AI Motion Control provides AI-powered motion control technology that enables users to:
- Upload images and reference videos
- Generate videos with motion transfer applied to uploaded images
- Access AI-generated content creation tools
- Manage credits and subscriptions for service usage
You must be at least 13 years of age to use our Services. If you are under 18, you must have permission from a parent or legal guardian. By using our Services, you represent and warrant that you meet these eligibility requirements.
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must immediately notify us of any unauthorized use of your account
- Choose a strong password and keep it confidential
- Do not share your account with others
- We are not liable for any loss or damage arising from your failure to maintain account security
We offer multiple subscription tiers (Free, Pro, Lifetime) with varying features and credit allocations as described on our pricing page.
- Credits are required to generate AI motion control videos
- Credits expire according to the terms of your plan
- Unused credits do not roll over unless specified in your plan
- Credits are non-transferable and non-refundable except as required by law
- Subscription fees are billed in advance on a recurring basis (monthly or yearly)
- Payment processing is handled securely through Stripe
- You authorize us to charge your payment method for all fees
- Failed payments may result in service suspension
- Price changes will be communicated 30 days in advance
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- Refunds are provided in accordance with our refund policy and applicable law
- Unused credits are forfeited upon cancellation
You agree not to:
- Upload content that is illegal, harmful, or violates third-party rights
- Upload content containing minors without proper authorization
- Create deepfakes or misleading content intended to deceive
- Upload content that is obscene, pornographic, or sexually explicit
- Generate content that promotes violence, hatred, or discrimination
- Use our Services in any way that violates applicable laws or regulations
- Attempt to reverse engineer, decompile, or extract our AI models
- Engage in automated scraping, data mining, or bulk downloads
- Attempt to gain unauthorized access to our servers or networks
- Use our Services to distribute malware or other harmful code
- Circumvent usage limits, credits system, or payment requirements
- Resell or redistribute our Services without authorization
- Impersonate others or misrepresent your affiliation
- API access is subject to rate limits and usage quotas
- API keys must be kept confidential and secure
- Abusive API usage may result in immediate suspension
- Our Services, including all content, features, technology, and functionality, are owned by AI Motion Control and protected by international intellectual property laws
- Our trademarks, logos, and brand features may not be used without permission
- You retain ownership of all images, videos, and content you upload ("User Content")
- You represent and warrant that you have all necessary rights to upload User Content
- You are responsible for ensuring your User Content does not infringe third-party rights
By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:
- Process your content through our AI models
- Store and display your content as necessary to provide Services
- Use anonymized/aggregated data to improve our AI models
- This license terminates when you delete your content, except for backup copies
- You own the output videos generated by our Services ("Generated Content")
- Commercial use of Generated Content is permitted for Pro and Enterprise plan subscribers
- Free plan users receive personal use rights only
- You are responsible for compliance with applicable laws when using Generated Content
- We reserve the right to use anonymized Generated Content for service improvement
Our Services may integrate with or utilize third-party services (including Kling AI for motion control processing). Your use of third-party services is subject to their respective terms and policies. We are not responsible for third-party services.
We reserve the right to:
- Review, monitor, and remove User Content that violates these Terms
- Suspend or terminate accounts that violate our policies
- Report illegal content to appropriate authorities
- Use automated and manual moderation tools
- Our Services are provided "as is" and "as available"
- We do not guarantee uninterrupted, secure, or error-free service
- We may modify, suspend, or discontinue Services at any time
- Scheduled maintenance will be communicated when possible
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the past 12 months
- We are not liable for service interruptions, data loss, or unauthorized access
- We are not responsible for the accuracy or quality of AI-generated content
You agree to indemnify and hold harmless AI Motion Control from any claims, damages, losses, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your User Content or Generated Content
- Your use of our Services
- Your violation of third-party rights
You may terminate your account at any time through account settings.
We may suspend or terminate your account immediately if you:
- Violate these Terms or our policies
- Engage in fraudulent or illegal activities
- Fail to pay applicable fees
- Misuse our Services
- Your access to Services will cease
- Unpaid fees remain due
- Certain provisions (intellectual property, limitation of liability) survive termination
These Terms are governed by the laws of the jurisdiction where AI Motion Control operates, without regard to conflict of law provisions.
Any disputes will be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.
You agree to resolve disputes individually and waive the right to participate in class actions.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting updated Terms on this page
- Updating the "Last Updated" date
- Sending email notification for significant changes
Continued use of Services after changes constitutes acceptance of updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Motion Control.
If any provision is found unenforceable, the remaining provisions continue in effect.
Our failure to enforce any right or provision does not constitute a waiver.
We may assign our rights and obligations. You may not assign your rights without our consent.
